TERMS OF USE (EULA)

1. Acceptance of Terms

Welcome to BackYard Ultra Timer ("Application"), provided by FellCode / Toni Limnell ("we", "us", "Developer"). By downloading, installing, or using the Application, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Application.

2. Nature of the Service

The Application is a specialized timing utility designed for Backyard Ultra format endurance events. It provides countdown timers, loop tracking logic, and audio alerts consistent with the 60-minute loop format.

3. Trial Period and Purchasing

3.1. Usage-Based Free Trial

The Application offers a "3-Round Free Trial". You may use the full functionality of the Application to time up to three (3) consecutive loops (rounds) free of charge. This Trial is provided to allow you to verify that the Application functions correctly on your specific device (including audio volume, battery consumption, and screen visibility).

3.2. One-Time Purchase (Premium Unlock)

To continue using the timer beyond the 3rd round, you must purchase the "Premium Unlock". This is a one-time fee processed securely through the Google Play Store.

3.3. EU/EEA/UK Right of Withdrawal & Waiver

If you are a consumer located in the European Union, European Economic Area, or the United Kingdom, you typically have a statutory right to withdraw from contracts for digital goods within 14 days.

HOWEVER, by clicking "Buy" or "Purchase" within the Application to unlock the Premium features:

You expressly request immediate performance of the contract (i.e., immediate unlocking of the App).

You expressly acknowledge and agree that you lose your statutory right of withdrawal once the download/unlocking has begun.

Therefore, ALL SALES ARE FINAL and non-refundable, except where the Application is technically defective as defined by applicable consumer protection laws.

4. Battery and Device Management

4.1. Wake Lock Warning: The Application uses a WAKE_LOCK feature to keep your device's screen powered on continuously during the race to ensure the timer is visible. This consumes significant battery power.

4.2. User Responsibility: You are solely responsible for ensuring your device has sufficient battery charge or is connected to an external power source (power bank) during use. FellCode is not liable for any data loss, missed start times, or race disqualification ("DNF") resulting from your device powering down.

5. Intellectual Property

The Application, including its source code (.kt files), design, and logic, is the exclusive property of FellCode / Toni Limnell. "Backyard Ultra" is a race format concept; this Application is a third-party tool and is not affiliated with, endorsed by, or associated with Big's Backyard Ultra, Lazarus Lake, or any official race organization.

6. User Obligations

You agree not to:

Use the Application for any unlawful purpose.

Attempt to bypass the 3-round trial limitation through technical manipulation.

Rely solely on the Application for critical safety or survival decisions during endurance events.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Finland, without regard to its conflict of law provisions. Any disputes shall be resolved in the district courts of Finland.
