ApexPace - Terms of Use

Welcome to the ApexPace application ("Service"), provided by FellCode ("us", "we", "our"). These Terms of Use ("Terms") govern your use of the Service.

By downloading, installing, or using the Service, or by clicking "I Accept," you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

1. Service Description

ApexPace is a tool designed to help users estimate and predict training results (such as pace and energy consumption) based on user-inputted data and/or GPX files.

The Service is offered as a free version ("Free Version") as well as paid subscriptions ("Monthly Subscription", "Annual Subscription"), which unlock additional features.

2. Disclaimer

You agree that you use the Service entirely at your own risk.

The information, calculations, and predictions provided by the Service are ESTIMATES ONLY. They are NOT medical advice, diagnoses, or treatment recommendations.

You are solely responsible for your own health and safety. Always listen to your body and consider your own health status.

If you are uncertain, consult a physician or other healthcare professional before starting or modifying any exercise program.

We refer to our full Disclaimer, which is an integral part of these Terms.

3. Subscriptions and Payments The Service may offer paid subscriptions (Monthly Subscription and Annual / Yearly Subscription).

3.1 Billing and Payments Billing: All payments are processed through the Google Play Store. Billing occurs on a recurring basis (monthly or annually) at the beginning of the subscription period. By purchasing a subscription, you agree to pay the price clearly stated within the application at the time of purchase.

3.2 Subscription Cancellations Cancellations: You may cancel your paid subscription at any time through your Google Play account settings. The cancellation will take effect at the end of the current billing period, and you will have access to the Service until the end of this period. Please note that uninstalling the Service from your device does not cancel the subscription.

3.3 Statutory Right of Withdrawal (EU/EEA) As a consumer, you generally have the right to withdraw from a subscription contract for a digital service within 14 days of concluding the contract, without giving any reason.

Exception to the Right of Withdrawal: However, under EU/EEA consumer protection laws regarding digital content not supplied on a tangible medium, you lose this right of withdrawal if the performance of the service has begun with your prior express consent and your acknowledgement that you thereby lose your right of withdrawal.

Acknowledgement: By purchasing a subscription (Monthly or Annual) and clicking the confirmation button in the purchase process, you:

Give your express consent to the immediate commencement of the provision of the Service (digital content); and

Acknowledge that you thereby lose your statutory 14-day right of withdrawal once the purchase is confirmed and the Service becomes available to you.

Consequently, you cannot claim a refund based on the statutory right of withdrawal for the subscription period once the purchase is completed.

4. User ObligationsYou agree not to use the Service for any unlawful purpose. You are responsible for the accuracy of the data you provide (such as base pace). Incorrect input data will lead to incorrect estimates.

5. Intellectual Property Rights

The Service, including its original code, appearance, features, and functionality, is the property of FellCode / Toni Limnell and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, revocable license to use the Service for personal, non-commercial use in accordance with these Terms.

6. Termination of Terms

By the User: You may cease to be bound by these Terms at any time by uninstalling the Service from your device.

By Us: We may terminate or suspend your access to the Service immediately, without prior notice, if you breach these Terms.

7. Changes to Terms

We reserve the right to modify these Terms at any time. If a change is material, we will notify you via the application or by email at least 30 days before the new terms take effect.

If a change adversely affects your access to or use of the Service (and the effect is not minor), you have the right to terminate the contract free of charge within 30 days of the notification.

8. Applicable Law and Dispute Resolution

These Terms shall be governed by the laws of Finland, without regard to its conflict of law provisions. Any disputes arising from these Terms shall primarily be resolved through negotiation.

However, this choice of law does not deprive you of the protection afforded to you by mandatory consumer protection provisions of the law of your country of residence.

Before you begin using the ApexPace application ("Service"), it is critically important that you understand and agree to the following:

1. Not Medical Advice

ApexPace is NOT a medical device. The information, calculations, predictions, and estimates provided by the Service (including pace, duration, and energy consumption) are NOT medical advice, diagnoses, or treatment recommendations.

The Service is intended solely as an informational estimation tool.

2. Estimates Only

All results produced by the Service are estimates. They are based on mathematical models and user-inputted data (such as base pace or GPX data).

Your actual results in training or a race may vary significantly due to numerous factors, such as weather, personal fitness level, nutrition, fatigue, route accuracy, and other unforeseeable circumstances.

3. Use at Your Own Risk

You use the Service entirely at your own risk. You are solely responsible for your own health, safety, and all decisions related to your training.

Always listen to your body. Never disregard professional medical advice or delay in seeking it because of information you have received from the Service.

If you are uncertain, consult a physician or other healthcare professional before starting or modifying any exercise program.

4. Service Quality and Warranty

FellCode (the provider of the Service) makes no warranties regarding the accuracy, reliability, or completeness of the information available through the Service. We provide the Service with professional skill and care.

However, we do not guarantee that the Service will operate completely uninterrupted or error-free under all circumstances. This does not limit your statutory rights concerning the conformity of the Service.

5. Limitation of Liability

To the fullest extent permitted by applicable law, FellCode, its owner, or its developers shall not be liable for any indirect or incidental damages arising out of the use of, or inability to use, the Service.

However, nothing in these terms shall exclude or limit our liability for death or personal injury resulting from our negligence, for fraud, or for any other liability that cannot be excluded or limited by law.
