TERMS OF SERVICE

PLEASE READ CAREFULLY: THESE TERMS INCLUDE A BINDING ARBITRATION AGREEMENT AND A CLASS ACTION WAIVER (SECTION 9) THAT AFFECT YOUR LEGAL RIGHTS.

By downloading, installing, or using the Backyard Ultra Timer ("Service"), you agree to be bound by these Terms of Service ("Terms") between you and FellCode ("we," "us").

1. License and Access

1.1 Limited LicenseFellCode grants you a personal, non-exclusive, non-transferable, revocable license to use the Service on Android devices you own or control, solely for your personal use in tracking timing events.

1.2 "Freemium" Trial Model (3-Round Limit)

The Service is provided under a specific trial model to allow you to verify functionality:

Evaluation Mode: You may use the Service to track up to three (3) consecutive rounds (loops) per session free of charge.

Technical Limitation: Upon completion of the 3rd round, the timer functionality will lock until the Premium Upgrade is purchased. Attempting to bypass this limitation using technical exploits is a violation of these Terms.

1.3 Premium Upgrade (One-Time Purchase)

To unlock unlimited rounds, you may purchase the "Premium Upgrade" via Google Play.

Type: This is a one-time, non-consumable purchase, not a subscription.

Scope: The purchase grants a lifetime unlock for the Service on the Google Account used for the transaction.

No Recurring Fees: You will be charged once. There are no weekly, monthly, or annual renewal fees.

2. Assumption of Risk and Safety Disclaimer

THE SERVICE IS A SOFTWARE UTILITY, NOT A MEDICAL DEVICE OR SAFETY MONITOR.

2.1 Nature of Backyard Ultra EventsYou acknowledge that "Backyard Ultra" and "Frontyard Ultra" events involve extreme endurance, sleep deprivation, and physical exhaustion. Participating in such activities carries inherent risks of severe injury, rhabdomyolysis, cardiac events, and death.

2.2 Voluntary UseYour use of this Service to track such activities is entirely voluntary. You assume full responsibility for your health and safety. The Service calculates time based on mathematical algorithms; it does not and cannot monitor your physiological state.

2.3 Release of LiabilityTO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU RELEASE FELLCODE AND ITS DEVELOPERS FROM ANY LIABILITY FOR PHYSICAL INJURY, HEALTH COMPLICATIONS, OR DEATH OCCURRING WHILE USING THE SERVICE. You agree that the decision to start a new loop (round) is solely yours, regardless of what the timer indicates.

3. Refunds and Purchases

3.1 Try Before You BuyBecause the Service offers a fully functional 3-round trial, allowing you to test compatibility with your specific device, all sales are final. We generally do not offer refunds for the one-time purchase, except as required by applicable consumer protection laws or Google Play's refund policy.

3.2 Google Play ManagementAll billing disputes, refund requests, and transaction issues are handled directly by Google Play. FellCode does not have the ability to issue refunds directly to your credit card.

4. Technical Reliability and Battery Optimization

4.1 "As Is" ServiceThe Service is provided "AS IS" without warranties of any kind. We do not warrant that the timer will be error-free or uninterrupted.

4.2 Battery Optimization Warning

You acknowledge that the Android Operating System employs aggressive battery optimization features that may suspend background apps or silence alarms (Do Not Disturb modes).

User Responsibility: It is your sole responsibility to configure your device settings (e.g., "Whitelisting" the app from battery savers, enabling "Keep Screen On") to ensure the timer functions correctly.

No Liability for DNF: FellCode is not responsible for any "Did Not Finish" (DNF) results, disqualifications, or missed starts caused by your device terminating the application process or silencing audio alerts.

5. Intellectual Property

The Service, including its source code (Kotlin), visual design (timer circles), and audio assets, is the proprietary property of FellCode. "Backyard Ultra" is a descriptive term for a race format; this application is a third-party tool and is not affiliated with or endorsed by the official Backyard Ultra organization or Lazarus Lake.

6. User Conduct

You agree not to:

Reverse engineer, decompile, or attempt to extract the source code of the Service.

Redistribute, sell, or rent the Service to third parties.

Use the Service to organize illegal events.

7. Limitation of Liability

IN NO EVENT SHALL FELLCODE BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF DATA, LOSS OF COMPETITION PRIZES, OR EQUIPMENT FAILURE) ARISING OUT OF THE USE OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE APP.

8. Changes to Terms

We reserve the right to modify these Terms. If we make material changes (e.g., changing the scope of the license), we will provide notice through the Service. Your continued use of the Service constitutes acceptance of the modified Terms.

9. Dispute Resolution (Arbitration & Class Action Waiver)

9.1 Binding ArbitrationAny dispute arising under these Terms shall be resolved through binding arbitration administered by the International Chamber of Commerce (ICC) under its Rules of Arbitration. The seat of arbitration shall be Wilmington, Delaware, USA.

9.2 Governing LawThese Terms are governed by the laws of the State of Delaware, excluding its conflict of laws principles.

9.3 Class Action WaiverYOU AGREE TO RESOLVE DISPUTES WITH US ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
