PLEASE READ CAREFULLY. BY DOWNLOADING, ACCESSING, OR USING THE BACYARULTRA TIMER ("SERVICE"), YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF USE ("TERMS") AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE, YOU MUST NOT USE THE SERVICE.

1. Description of Service and Non-Affiliation

1.1 Service: Backyard Ultra Timer is a utility application designed to track time, loops ("yards"), and intervals for endurance running events following the "Backyard Ultra" format (4.167 miles per hour).

1.2 Non-Affiliation Disclaimer: This Service is an independent product developed by FellCode. It is NOT affiliated with, endorsed by, sponsored by, or connected to "Big's Backyard Ultra," Lazarus Lake (Gary Cantrell), or the official Backyard Ultra organization. Any use of the term "Backyard" is solely for descriptive purposes to indicate the utility of the Service for this specific race format.

2. CRITICAL HEALTH AND SAFETY DISCLAIMER (ASSUMPTION OF RISK)

WARNING: PARTICIPATION IN BACKYARD ULTRA EVENTS INVOLVES EXTREME PHYSICAL AND MENTAL STRESS.

2.1 No Medical Advice: The Service is a passive timing tool. It does not monitor your vital signs or health status. Data provided (e.g., remaining loop time) is for reference only and is not medical advice.

2.2 Assumption of Risk: You acknowledge that ultrarunning, especially formats involving sleep deprivation and durations exceeding 24 hours, carries inherent risks of severe injury or death. By using this Service, you voluntarily assume all risks associated with such activities, including but not limited to:

Physiological Injury: Rhabdomyolysis (muscle breakdown), acute kidney injury, cardiac arrest, arrhythmia, heat stroke, hypothermia, and electrolyte imbalance.

Neurological & Psychological Effects: Visual and auditory hallucinations, disorientation, loss of coordination, and cognitive impairment resulting from extreme sleep deprivation.

Environmental Hazards: Accidents caused by running at night, on trails, or near traffic while in a state of fatigue or confusion.

2.3 Release of Liability: TO THE FULLEST EXTENT PERMITTED BY LAW, YOU HEREBY RELEASE, WAIVE, AND DISCHARGE FELLCODE, ITS OWNERS (INCLUDING TONI LIMNELL), DEVELOPERS, AND PARTNERS FROM ANY AND ALL LIABILITY, CLAIMS, OR CAUSES OF ACTION ARISING OUT OF OR RELATED TO ANY INJURY, DEATH, OR LOSS SUSTAINED BY YOU WHILE USING THE SERVICE, WHETHER CAUSED BY NEGLIGENCE OR OTHERWISE.

3. Trial Period and Purchasing

3.1. Usage-Based Free Trial

The Application offers a "3-Round Free Trial". You may use the full functionality of the Application to time up to three (3) consecutive loops (rounds) free of charge. This Trial is provided to allow you to verify that the Application functions correctly on your specific device (including audio volume, battery consumption, and screen visibility).

3.2. One-Time Purchase (Premium Unlock)

To continue using the timer beyond the 3rd round, you must purchase the "Premium Unlock". This is a one-time fee processed securely through the Google Play Store.

By starting the trial, you explicitly consent to this automatic conversion and the recurring charges disclosed to you at sign-up.

4. Technical Limitations

4.1 Battery & Background Execution: The Service requires background execution to sound alarms. You acknowledge that Android operating systems (especially Android 14/15) may terminate background apps to save battery. It is your responsibility to configure your device (e.g., disable battery optimization for this App) to ensure reliability. FellCode is not liable for missed starts ("Timed Out") or disqualification (DNF) resulting from device failure or OS intervention.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FELLCODE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA OR DISQUALIFICATION FROM A COMPETITION, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

6. Dispute Resolution and Class Action Waiver

6.1 Binding Arbitration: Any dispute regarding these Terms shall be resolved by binding arbitration administered by the American Arbitration Association (AAA).

6.2 Class Action Waiver: YOU AND FELLCODE AGREE TO BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

7. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
