Privacy Policy: ApexPace (United States)

This Privacy Policy ("Policy") describes how FellCode ("we", "us", "our") collects, uses, and protects your personal information when you use the ApexPace mobile application ("Service") in the United States.

1. Information We Collect and Its Purpose (Notice at Collection)

We provide this notice in accordance with California and other applicable state laws. We collect personal information to provide and improve the Service. We do not sell your personal information.

  • A. Information We Collect

  • User-Provided Data:

  • Workout Data: Base pace, distances, elevation gain (nousumetrit), and segment lengths entered by the user.

  • Energy Calculator Data: Entered paces and corresponding carbohydrate amounts.

  • GPX Files: GPX files opened separately by the user, which contain GPS location routes. This data, including Sensitive Personal Information such as precise geolocation, is processed ONLY locally on your device. We never upload, store, or access these files on our servers.

  • Automatically Collected Data:

  • Subscription Data: Subscription type and purchase history via Google Play Billing, using an anonymous purchase ID.

  • Analytics Data: We use Firebase Analytics to collect anonymous data about Service usage, such as an anonymous device identifier, device model, and general user events.

  • Crash Reports: We collect an anonymous technical report via Firebase Crashlytics to diagnose problems.

  • Approximate Location: We collect your approximate location based on your IP address (e.g., country) to display the correct legal terms.

  • B. Purposes for Data Use

  • To Provide the Service: We use your workout and GPX data to calculate your requested predictions and your subscription data to manage your subscription.

  • To Improve the Service: We use anonymous analytics and crash report data to understand how the Service is used and to improve the user experience.

  • To Comply with Legal Obligations: We use your approximate location to display the correct terms of use to you.

  • C. Data Retention

  • We retain personal information only for as long as necessary. Analytics data is retained for a maximum of 26 months. Subscription data is retained for the duration of your subscription and as required by applicable accounting laws.

2. Data Sharing and Disclosure

We do not sell your personal information. We may "share" certain information as defined by California privacy laws (CCPA/CPRA) with service providers.

  • Service Providers: We share data with the following partners:

  • Google (Google Play & Firebase): Processes payments, subscription data, and anonymous analytics and crash data.

  • RevenueCat: Processes anonymous subscription identifiers for subscription management.

3. Your U.S. Privacy Rights

If you reside in California or another state that grants similar rights, you have the following rights regarding your personal information:

  • Right to Know/Access: The right to request information about the personal information we have collected.

  • Right to Delete: The right to request that we delete the personal information we have collected from you, subject to certain exceptions.

  • Right to Correct: The right to request that we correct inaccurate personal information.

  • Right to Opt-Out of Sale or Sharing: You have the right to opt-out of the "sharing" of your personal information. We use analytics identifiers that may be considered "sharing." You can exercise this right via the "Do Not Sell or Share My Personal Information" link found in the application's settings menu.

  • Right to Limit Use of Sensitive Personal Information: Because we do not collect or store your Sensitive Personal Information (such as precise location) on our servers, this right is not applicable to our Service.

  • Right to Non-Discrimination: We will not discriminate against you for exercising your rights.

4. Children's Privacy

Our Service is not directed to children under the age of 13. We do not knowingly collect personal information from anyone under the age of 13. If you are a parent and believe your child has provided us with personal information, please contact us.
